Due to the nature of the business and the fact that Genesee Valley Center is private property, the following policies and procedures must be followed. In order to assure a group's activities will not interfere with the operation of Genesee Valley Center or its tenants, management requests the following information prior to permitting access to the common area and/or parking lots.

Requests

  • Access requests must be submitted in writing 90 days prior to the event or activity.

Names and Addresses

  • The name, address and telephone number of the group and of the individual in charge and the names of all persons who may be involved.
  • This information is appropriate because the center is entitled to determining whether the group or any of the participating individuals have caused personal injury or property damage in the past.
  • The center is entitled to prohibit anyone who has a poor history and anyone not on this list, from engaging in any activity on the property.

Prior Activities

  • The group must provide a list of all locations in which the group has conducted expressive activity in the recent past.
  • The center will make appropriate contacts to determine whether problems have arisen. Depending on the circumstances, the occurrence of disruption in prior activities might or might not justify a denial of the request.
  • If it does not, the information can be taken into account in determining the location of the activity, the amount of insurance or deposit required, the number of persons who will be permitted to participate at any one time, and other parameters of the activity.

Submittal of Literature

  • Samples of all written materials, including posers or placards intended to be displayed, should be required to be submitted for pre-approval.
  • The center is permitted to prohibit materials which contains obscenity or highly inflammatory or political messages.
  • The center prohibits "hate speech" or disparaging comments directed at racial, ethnic or other groups, any implication that the center supports the message being conveyed or any other message which is otherwise prohibited.
  • No solicitation of any kind is permitted in the common area.

Location

  • The center is entitled to limit the areas in which expressive activity is permitted.
  • Locations that are off limits, would result in fire code violations or interfere with pedestrian movement or the operation of individual businesses.
  • Opposing views and campaigns are not permitted in the center at the same time.

Time

  • All activity is prohibited during high-volume periods such as holidays and seasonal sales.

Security

  • Based upon prior history of the group, the center can require a security deposit of up to $500.
  • A $2 million liability insurance rider is required for all activities.

Disclaimer

  • Genesee Valley Center, its owners, partners and sponsors can display signage near the activity disclaiming the group, message and activity.

These policies and procedures will be implemented uniformly whenever a request is made to access the building and properties hereby known as Genesee Valley Center, operating in Flint Township, Michigan.
